SUBSCRIPTION AGREEMENT
This Subscription Agreement ("Agreement") is entered into by and between pitchpilot LLC., a Delaware company ("we," "us," or "our"), and the customer ("you") identified in the Order Form.
1. TERM AND TERMINATION
The term of this Agreement will begin on the Effective Date and will continue for the duration of the subscription period specified in the Order Form. Upon expiration of the initial term, this Agreement will automatically renew for successive periods of equal length unless either party gives written notice of termination to the other at least thirty (30) days prior to the end of the then-current term. The customer may terminate or stop the subscription at any time through the service, automatically waiving the thirty (30) day notice period.
2. SUBSCRIPTION FEES
You agree to pay the subscription fees as specified in the Order Form. All subscription fees are non-refundable and non-cancelable. Subscriptions are billed on a per-monthly basis.
3. PAYMENT TERMS
All payments will be made in accordance with the payment terms specified in the Order Form. You are responsible for paying all applicable taxes, duties, and fees associated with your use of the Service.
4. SUPPORT
We will provide support for the Service as specified in the Order Form. pitchpilot LLC., will perform service at a best-effort basis, while making no guarantees of remediation of technical issues. No Service Level Agreement is provided for support.
5. TERMINATION FOR CONVENIENCE
Either party may terminate this Agreement upon written notice to the other party.
6. EFFECTIVE DATE
The effective date of this Agreement is the date of the Order Form.
7. GOVERNING LAW AND JURISDICTION
This Agreement will be governed by and construed in accordance with the laws of [Delaware, United States of America]. Any disputes arising out of or in connection with this Agreement will be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.
8. AMENDMENTS
We reserve the right to modify or change this Agreement at any time without notice. Your continued use of the Service after the effective date of any changes will constitute your acceptance of the modified Agreement.
9. Service Credits
We may issue service credits as part of a support remediation process.
